Please read this section carefully, it forms an important part of the contract between you and Genius Loci Travel as it sets out our respective rights and obligations. Bookings with Genius Loci Travel are accepted only in accordance with the terms and conditions set out below.
Genius Loci Travel is a registered company (P.IVA 03800410650), registered address Via A. Rotondo, 5 54127 Salerno and an authorised tour operator.
It is a condition of booking to provide us with a valid and adequate travel insurance. It is strongly recommended to check that the insurance you hold has been specially tailored to cover all activities undertaken as part of your holiday, as well as medical risks (including any risk related to pre-existing medical conditions, emergency repatriation including helicopter rescue and air ambulance where applicable, and liability) and cancellation risks.
2. How to book and pay for your holiday
A reservation can be made in several ways; directly via this website (using the booking form provided) by sending an e-mail or if you prefer you can contact us by phone. To confirm your booking you need to pay a deposit of 25% of the selected holiday. This can be done by credit card (subject to a levy of 2%) or by money order. Your booking is confirmed when you receive the invoice from us stating that you have paid the deposit and consequently a contract between us comes into existence. When you receive the confirmation invoice please check the details carefully and inform us immediately should anything be incorrect. Full payment is due not later that 6 weeks before departure (42 days). If we do not receive all payments due in full and on time we reserve the right to treat your booking as cancelled and cancellation charges will apply. Please read cancellation fees’ section below for more details. Late bookings are subject to availability and full payment is required at the time of booking.
All prices we advertise on this website are accurate and are updated regularly, but we reserve the right to change any of them (whether or not you have paid only a deposit or the full holiday cost) in relation to changes in transportations costs or in the unlikely event of price changes beyond Genius Loci Travel’s control. Before you finalise your booking you will receive the up-to-date tour price, including the extra costs for any additional service, or upgrade requested.
All tour prices are per person and on twin share basis.
4. If you have to alter
If you wish to change your booking in any way we will do our best to make it possible. All booking amendments are subject to availability of all suppliers providing the services included in your selected travel package. Please understand that a fee of € 100,00 will be charged to cover administration costs if your amendment request is received by Genius Loci Travel 28 days prior to the original departure dates. If notification is received later than the term indicated above cancellation charges will apply.
5. If you have to cancel
If for any reason you have to cancel your holiday we must receive notification of it in writing and the following cancellation fees will apply:
- 41 – 28 days before departure Loss of deposit
- 27 – 16 days before departure 50% of the holiday price
- 15 – 8 days before departure 75% of the holiday price
- 7 or fewer days before departure 100%
6. If we have to cancel or alter
In the unlikely event that Genius Loci Travel has to cancel your holiday, you have the chance to transfer to an alternative holiday (if the price is lower we will refund the difference, if it is higher you may be charged the additional amount) or if you wish you can receive a full reimbursement of the holiday cost.
Although we plan your travel arrangements months in advance, changes to the itinerary may occur, even after the tour has started, due to local circumstances.
You acknowledge that travelling with us requires a certain grade of flexibility, requested by the nature of the tour we organise. Sometimes changes may be made to the itinerary due to Force Majeure, weather conditions, poor state of the paths (treks), changes in transport schedules, vehicle breakdown, etc. Genius Loci Travel reserves the right to substitute hotels, restaurants, routes or other services listed in the itinerary with comparable services if necessary.
7. Health, Fitness and Age Limits
Activities involved in active travel may be physically demanding, strenuous and potentially dangerous. By booking with us, you acknowledge that you are in suitable physical and mental condition to perform the activities described herein.
8. (Exclusion of) Liability
Our obligations and those of our suppliers in providing any service or facility included in your holiday, are to take reasonable skill and care to arrange for the provision of such services and facilities and where we or our suppliers is actually providing the service or facility, to provide them with reasonable skill and care.
You must show that reasonable skill and care has not been used if you wish to make any claim.
Genius Loci Travel, its agents, servants and employees shall not be responsible for personal injuries or property damage, loss or delay, or change of itinerary incurred by any person or tour participant arising out of the act of negligence of others nor shall Genius Loci Travel be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Genius Loci Travel or of any agent or supplier, or due to force majeure.
Genius Loci Travel will not accept any responsibility if you contravene any law or regulation of the country or the region visited. You acknowledge that any optional activity you may undertake during the trip is completely at your own risk.
Bicycles (where applicable) provided for use during cycling tours are in satisfactory operating condition and you agree to use them at your own risk Should you notice any damage compromising its safety you must report it immediately to the tour leader or to our office. You are required to wear a helmet while cycling. Genius Loci Travel will not accept responsibility should you not accomplish such requirements
Walking tour participants are required to use walking boots.
Our priority is to give you an enjoyable holiday and we work very hard to make this happen. However if you are not happy with any of your travel arrangements or there is anything about which you may wish to complain you should report it immediately, either to your tour leader (if you are on a group tour) or to our office, so that the problem can be immediately sorted. If we are unable to help and you still have a complaint then you should report it in writing to us within 30 days of your return.
10. Tour Participation and Conditions of Exclusion
Genius Loci Travel reserves the right to decline to accept or retain as a client anyone whose conduct is disruptive to the enjoyment of other clients, or whose behaviour may cause prejudice to the good reputation of Genius Loci Travel.
On group tours you acknowledge the authority of the tour leader in all matters that are likely to affect the safety and well-being of the trip. Genius Loci Travel (by the tour leader or representative) reserves the right to terminate this contract in case you refuse to comply with Tour Leader decisions on such matters. In these cases no refund will be applicable.
11. Your contract
Your contract with us is governed in all respects by Italian laws (law 27/12/1977 n. 1084, ratifying and executing the International Convention concerning the travel contract (CCV), signed in Brussels on 23.4.1970. In the unfortunate event of a financial failure the Prime Minister decree of 23/07/99, n. 349 G.U. n. 249 of 12/10/1999 and its Guarantee Fund may be applicable. This Fund should enable customers to get reimbursement of the cost of the travel package, when the financial failure of the travel agent has not allowed costumer to start or continue their holiday. Any dispute arising shall be subject to Italian Courts.
